Emerald Cleaners' Terms of Service

Welcome to Emerald Cleaners. These Terms and Conditions govern the use of our cleaning services. By booking our services, you agree to be bound by the following terms and conditions. Please read them carefully before proceeding with any service request.

1. Service Agreement

By booking a service, you confirm that you are the property owner or have permission from the property owner to request cleaning services. Services provided by Emerald Cleaners are limited to the scope agreed upon at the time of booking. Our cleaning professionals will carry out their work to the best of their ability. However, we do not guarantee the removal of all stains, mold, or permanent damage. Additional services requested beyond the agreed scope may incur extra charges.

2. Payment Policy

All payments must be made in full before the service begins unless otherwise agreed upon. We accept online payments, credit/debit cards, and other payment methods as specified on our website. If a payment is declined or disputed, services may be suspended until the issue is resolved.

3. No Refund Policy

Payments for our services are non-refundable once the service has been completed. If you are dissatisfied with our service, you must notify us within 24 hours for a resolution or partial refund consideration.

4. Cancellation & Rescheduling Policy

No cancellations are allowed once a booking has been confirmed. Rescheduling is permitted with at least 24-hour notice, subject to availability. If you fail to reschedule in advance, you forfeit your payment.

5. Partial Refunds Policy

A partial refund may be issued if a service was not completed due to Emerald Cleaners' fault. Refund requests must be made in writing within 24 hours of service completion. Refunds will not be issued for dissatisfaction based on subjective expectations or uncleanable stains.

6. No Returns Policy

Our services are intangible and cannot be returned. If you believe an issue was not addressed, contact us within 24 hours to request a touch-up service.

7. Damage & Liability Policy

Our team takes utmost care while providing cleaning services, but we are not liable for: Pre-existing damages. Damages due to the use of improper cleaning products as per the client’s request. Accidental breakage of fragile items not properly secured. Clients are advised to remove valuable and fragile items before the service. Any claims for damages must be reported within 24 hours with photographic evidence.

To the maximum extent permitted by law, Emerald Cleaners LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of our Website or Services.

8. Access to Property

The client must ensure that our team has access to the property at the scheduled time. If we are unable to access the property due to client negligence, the full service charge will still apply.

9. Health and Safety Compliance

Our cleaning professionals follow industry-standard safety protocols. We reserve the right to refuse service if conditions pose a health or safety risk (e.g., presence of hazardous materials, biohazards, extreme infestations).

10. Force Majeure

We are not liable for service interruptions or cancellations caused by circumstances beyond our control, such as natural disasters, power outages, or other unforeseen events.

11. Communication & A2P Compliance

By providing your contact information, you agree to receive appointment confirmations, reminders, and service updates via SMS, email, or phone calls. We comply with Application-to-Person (A2P) messaging regulations to ensure non-spammy, permission-based communications. You may opt out of SMS communications by following the opt-out instructions provided in our messages.

12. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by the laws of Iowa. Any disputes shall be resolved through mediation or arbitration before legal action is pursued.

13. Amendments

Emerald Cleaners reserves the right to update these Terms and Conditions at any time without prior notice. Continued use of our services after an update constitutes acceptance of the revised terms.

14. User Conduct

You agree not to use our Website or Services for any unlawful purpose or in any way that could damage, disable, or impair the Website or our Services. You also agree not to interfere with any other party's use of the Website or our Services.

15. Intellectual Property

All content on our Website, including but not limited to text, images, logos, and design, is the property of Emerald Cleaners LLC or its content suppliers and is protected by copyright and other intellectual property laws. Any unauthorized use of our content is strictly prohibited.

16. Indemnification

You agree to indemnify and hold harmless Emerald Cleaners LLC and its employees, contractors, agents, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of our Website or Services, your breach of these Terms, or your violation of any applicable laws or regulations.
